Terms of Service
The rules and commitments that govern your use of Pulsar67. Written to be readable, not just defensible.
1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you ("Customer," "you") and Pulsar67 ("we," "us," "our"). By creating an account, ordering a service, or using any part of our service, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, and our Service Level Agreement (together, the "Agreement").
If you don't agree, don't use the service.
2. Account & Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. You must provide accurate, current, and complete information during registration and keep that information updated.
You are responsible for all activity on your account, including any activity by sub-users you authorize. You must keep your password and API tokens confidential and notify us immediately if you suspect unauthorized access.
3. Services
We provide virtual private server ("VPS") hosting and related services. Specifications, features, and limits of each plan are described on our pricing and features pages and in your client area at the time of order.
We may add, modify, or remove features over time. We will not materially reduce the resources of an existing VPS plan you already pay for without giving you the option to cancel for a prorated refund.
4. Fees & Billing
4.1 Recurring fees
Services are billed in advance on a recurring monthly or annual basis, depending on the billing cycle you select. Renewal invoices are generated automatically before the start of each new term.
4.2 Payment methods
We accept major credit and debit cards, PayPal, and several cryptocurrencies. Bank transfer is available for annual Enterprise plans by request. All fees are charged in US dollars unless otherwise noted.
4.3 Taxes
Quoted prices exclude any applicable sales tax, VAT, or similar tax, which will be added at checkout where required by law. You are responsible for any taxes assessed in your jurisdiction.
4.4 Late payment
If a payment fails, we will retry and notify you. Services may be suspended after 5 days of overdue payment and terminated, with data deletion, after 14 days. Restoring a terminated service is not always possible.
5. Refunds & Cancellation
New customers may cancel their first monthly VPS order within 7 days of the first invoice for a full refund. The refund applies once per customer.
Annual plans, custom Enterprise configurations, and add-on consumption (extra bandwidth, additional IPs) are non-refundable beyond the initial 7-day window. You may cancel at any time to stop future renewals.
To cancel, open a ticket from the client area. Cancellations take effect at the end of the current billing period.
6. Your Obligations
- Use the service in compliance with our our Acceptable Use Policy and all applicable laws.
- Keep your VPS, software, and credentials reasonably secure (patches, strong passwords, SSH keys, etc.).
- Maintain your own backups of any data you cannot afford to lose. Our optional backup add-on assists but does not replace your responsibility.
- Respond to abuse complaints and security notices we forward from third parties.
- Provide accurate contact information so we can reach you for critical service notices.
7. Acceptable Use
Your use of the service is subject to our the full AUP, which is incorporated into these Terms by reference. Violations may result in suspension or termination as described in Section 10.
8. Service Availability
We commit to a 99.9% monthly uptime SLA, with service credits when we fall short. The full terms are in our our Service Level Agreement.
We may perform scheduled maintenance with at least 48 hours' notice. Emergency maintenance may be performed at any time when necessary to protect the integrity or security of the service.
9. Data & Backups
You retain all rights to data you store on your VPS. We do not access, read, or process the contents of your VPS storage except as strictly necessary to operate the service or as required by law.
You are responsible for backing up your data. Optional automated backups (included on Pro and Enterprise, available as an add-on on lower tiers) provide a convenience layer but are not a substitute for your own backup strategy.
Upon service termination, data is retained for 7 days and then permanently deleted. You may request earlier deletion via the client area.
10. Suspension & Termination
We may suspend or terminate your service if you violate these Terms, the AUP, or applicable law; if you fail to pay; if your account is involved in fraud or chargeback abuse; or if continued service poses a risk to our infrastructure or other customers.
Where the violation is not severe and not immediately harmful, we will attempt to notify you and give you a reasonable opportunity to cure. Severe or actively harmful violations may result in immediate suspension without prior notice.
You may terminate the service at any time by cancelling in your client area. Termination by either party does not entitle you to a refund except as provided in Section 5 or the SLA.
11. Intellectual Property
The Pulsar67 brand, logos, website, documentation, and software are owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use them solely as required to use the service.
You retain ownership of content you upload or generate using the service.
12. Disclaimers
Except as explicitly stated in the SLA, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the service will be uninterrupted, error-free, or that data loss will not occur. Internet connectivity, third-party services, and customer-side issues are outside our control.
13. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability arising out of or related to the Agreement, for any cause whatsoever, is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD $100.
We will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits; lost revenue; lost data; or business interruption, even if advised of the possibility of such damages.
14. Indemnification
You agree to indemnify and hold harmless Pulsar67, its officers, employees, and contractors from any third-party claim, loss, or expense (including reasonable legal fees) arising from your use of the service, your violation of the Agreement, your violation of any law, or your infringement of any third-party right.
15. Governing Law & Disputes
This Agreement is governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute arising from or related to this Agreement will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of those courts.
You and Pulsar67 agree to attempt to resolve disputes informally first by contacting support@pulsar67.com before initiating formal proceedings.
16. Changes to Terms
We may update these Terms from time to time. Material changes will be announced at least 30 days in advance through the client area and by email to the account contact on file. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
